How long can an employer hold a final paycheck? If an employee quits without giving advance notice, the employer must provide the final paycheck within 72 hours. Can I sue my employer for holding my check? While you do not have to hand them a paycheck on their last day of work, you may not withhold their paycheck until they have returned company property.
